Former vice principal sues Eastside Catholic over dismissal

Mark_ZmudaMark Zmuda, the vice principal who was forced to resign from Eastside Catholic School after marrying his partner in a same-sex wedding, is filing a discrimination lawsuit against the school and the Archdiocese of Seattle.

Zmuda’s attorney, Richard H. Friedman, said the lawsuit will be filed Friday, and a news conference will be held then to announce details.

Zmuda, a popular teacher, coach and vice principal at Eastside Catholic, was forced to resign after officials there learned of his marriage to his same-sex partner.

School officials said Zmuda had violated a signed agreement that his behavior would at all times be consistent with the values and teachings of the Catholic Church. The church does not recognize gay marriage.

Zmuda’s dismissal sparked two petition drives calling on the school to reinstate Zmuda to his post, but school officials refused to do so.

The archdiocese responded to the petitions, which gathered thousands of signatures, with a statement saying that they stood by the decision to replace Zmuda.

“In no way was their goal to be discriminatory to anyone but to be faithful to their mission as a Catholic school,” Archbishop J. Peter Sartain wrote.

Corey Sinser, a 2006 graduate of Eastside Catholic who led one of the petition drives, said Zmuda wants to come back to the school as an educator, but since that is no longer an option a lawsuit is “the next logical step.”

During the period of turmoil from the decision, Eastside Catholic President Sister Mary Tracy resigned.

UN committee blasts Vatican on sex abuse, abortion

The Vatican “systematically” adopted policies that allowed priests to rape and molest tens of thousands of children over decades, a U.N. human rights committee said Wednesday, urging it to open its files on pedophiles and bishops who concealed their crimes.

st petersIn a devastating report hailed by victims, the U.N. committee severely criticized the Holy See for its attitudes toward homosexuality, contraception and abortion and said it should change its own canon law to ensure children’s rights and their access to health care are guaranteed. The Vatican promptly objected.

The report puts renewed pressure on Pope Francis to move decisively on the abuse front and make good on pledges to create a Vatican commission to study sex abuse and recommend best practices to fight it. The commission was announced at the spur of the moment in December, but few details have been released since then.

The committee issued its recommendations after subjecting the Holy See to a daylong interrogation last month on its implementation of the U.N. Convention on the Rights of the Child, the key U.N. treaty on child protection, which the Holy See ratified in 1990.

Critically, the committee rejected the Vatican’s longstanding argument that it doesn’t control bishops or their abusive priests, saying the Holy See was responsible for implementing the treaty not just in the Vatican City State but around the world “as the supreme power of the Catholic Church through individuals and institutions placed under its authority.”

In its report, the committee blasted the “code of silence” that has long been used to keep victims quiet, saying the Holy See had “systematically placed preservation of the reputation of the church and the alleged offender over the protection of child victims.” It called on the Holy See to provide compensation to victims and hold accountable not just the abusers but also those who covered up their crimes.

“The committee is gravely concerned that the Holy See has not acknowledged the extent of the crimes committed, has not taken the necessary measures to address cases of child sexual abuse and to protect children, and has adopted policies and practices which have led to the continuation of the abuse by, and the impunity of, the perpetrators,” the report said.

It called for Francis’ nascent abuse commission to conduct an independent investigation of all cases of priestly abuse and the way the Catholic hierarchy has responded over time, and urged the Holy See to establish clear rules for the mandatory reporting of abuse to police and to support laws that allow victims to report crimes even after the statute of limitations has expired.

No Catholic bishop has ever been sanctioned by the Vatican for sheltering an abusive priest, and only in 2010 did the Holy See direct bishops to report abusers to police where law enforcement requires it. Vatican officials have acknowledged that bishop accountability remains a major problem and have suggested that under Francis, things might begin to change.

The committee’s recommendations are non-binding and there is no enforcement mechanism. Rather, the U.N. asked the Vatican to implement the recommendations and report back by 2017. The Vatican was 14 years late submitting its most recent report.

While most attention has focused on child sex abuse, the committee’s recommendations extended far beyond, into issues about discrimination against children and their rights to adequate health care, issues that touch on core church teaching about life and sexual morals.

The committee, for example, urged the Vatican to amend its canon law to identify circumstances where access to abortion can be permitted for children, such as to save the life of a young mother. It urged the Holy See to ensure that sex education, including access to information about contraception and preventing HIV, is mandatory in Catholic schools. It called for the Holy See to use its moral authority to condemn discrimination against homosexual children or children raised by same-sex couples.

The Vatican said it would study the report and in a statement reiterated its commitment to defending and protecting children’s rights that are enshrined in the treaty. But it took issue with the committee’s recommendations to change core church teaching on life.

“The Holy See does, however, regret to see in some points of the concluding observations an attempt to interfere with Catholic Church teaching on the dignity of human person and in the exercise of religious freedom,” the Vatican said.

Church teaching holds that life begins at conception; the Vatican therefore opposes abortion and artificial contraception. The Vatican has a history of diplomatic confrontation with the United Nations over such issues.

Austen Ivereigh, coordinator of Catholic Voices, a church advocacy group, said the report was a “shocking display of ignorance and high-handedness.”

He said it failed to acknowledge the progress that has been made in recent years and that the Catholic Church in many places is now considered a leader in safeguarding children. And he noted that the committee seemed unable to grasp the distinction between the responsibilities and jurisdiction of the Holy See, and local churches on the ground.

“It takes no account of the particularities of the Holy See, treating it as if it were the HQ of a multinational corporation,” he said in an email.

But victims groups hailed the report as a wake-up call to secular law enforcement officials to investigate the abuse and cover-up and prosecute church officials who are still protecting predator priests.

“This report gives hope to the hundreds of thousands of deeply wounded and still suffering clergy sex abuse victims across the world,” said Barbara Blaine, president of the main U.S. victim’s group SNAP. “Now it’s up to secular officials to follow the U.N.’s lead and step in to safeguard the vulnerable because Catholic officials are either incapable or unwilling to do so.”

Spain’s new cardinal says homosexuality a ‘defect’

Pope Francis’ newly chosen Spanish cardinal, 84-year-old Fernando Sebastian Aguilar, has described homosexuality as a “defect” that can be corrected with treatment, sparking condemnation from gay rights groups.

“A lot of people complain and don’t tolerate it but with all respect I say that homosexuality is a defective way of manifesting sexuality, because that has a structure and a purpose, which is procreation,” Sebastian told Malaga newspaper Sur.

The interview was published Sunday, a week after the Spaniard was named as one of 19 new cardinals chosen by the pope, to be officially appointed February 22.

“We have a lot of defects in our bodies. I have high blood pressure. Am I going to get angry because they tell me that? It is a defect I have that I have to correct as far as I can,” said Sebastian, who is the archbishop emeritus of the northern city of Pamplona.

“Pointing out a defect to a homosexual is not an offence, it is a help because many cases of homosexuality can be recovered and normalised with adequate treatment. It is not an offence, it is esteem. When someone has a defect, the good friend is the one who tells him.”

The archbishop was asked in the interview if he shared the view of Pope Francis, who said in July last year: “If someone is gay and seeks the Lord with good will, who am I to judge?”

The Spanish archbishop, who, because of his age, will not hold a vote in the conclave that elects pontiffs, said the pope shows respect to all people but is not changing the teaching of the Church.

“It is one thing to show welcome and affection to a homosexual person and another to morally justify the exercise of homosexuality,” he said.

Gay and lesbian rights group Colegas called on the archbishop to retract his comment.

“We hope that Fernando Sebastian will correct his words and we note that homosexuality is not a curable disease, but homophobia is,” it said in a statement.

Nicolas Fernandez, head of the Malaga-based gay and lesbian rights group Entiende, added his condemnation.

“It is not the first time the cardinals have said we are defective,” he said, calling for non-discrimination legislation that would condemn such “repugnant” statements.

‘Comfortable being gay’: a priest speaks

An Irish priest who has come out to many friends and colleagues says that he is ‘happy in his life’ and that the Catholic Church’s teaching on sexuality needs to change

He asks to be described as a religious-order priest comfortable with his sexuality. He is gay. It is “one aspect of his life”. He doesn’t like the term “gay priest”. Before this interview he pondered whether to let us publish his name. But, he realised, “I don’t have any desire to make a major dramatic statement. It doesn’t define me, and I don’t want to be defined by it. I don’t want to draw huge attention.”

A few years after his ordination he began to tell people about his sexuality. “I began to open up to friends and colleagues. Then it got to the point where I got tired telling. The need went away. Anyone who needs to know knows. It’s not an issue.”

He has been aware of his orientation since puberty. It played a part in his realising he had a vocation to the priesthood. “Despite the [church’s] negative teaching I never had the sense that God didn’t love me.”

In his teens he “used to call into the church on the way home from school. It was the one place where I could be myself. God knew who I was. My sense of a calling had its seeds there.”

He also realised that priesthood was “a way of doing something worthwhile without declaring orientation”. He feels he was lucky being an order priest when it came to formation. There was “none of the narrow-mindedness” he associated with the seminary in Maynooth. He and fellow students had “more freedom within the self. There was never a negative message. It was very broad-minded.”

While not spelling out issues around their own sexuality, they were encouraged to be “as open as we could be” and “to grow in relationships”. It helped too that he could read the works of contemporary moral theologians who wrote compassionately about homosexuality.

He came to realise some colleagues shared the same orientation but “very few were naming it as gay, but many were and still are, in hindsight.”

He agrees with former president Mary McAleese, who said in a Glasgow Herald interview, published last Tuesday, that significant numbers of Catholic priests are gay.

As a priest he has preached sympathetically about gay people and challenged the church’s teaching on homosexuality and its treatment of gay people. He was called in by a bishop once for doing so. In the main he has experienced no problems from the laity when he does so, apart from a few right-wing Catholics.

He believes that for some colleagues who share his orientation, becoming a priest was about “running away from sex while having a role and status in life”. Indeed, he felt that “probably a lot of men and women, gay or straight”, who became priests or nuns, “were running away from sexuality”.

But “if that is their primary reason, it is not enough unless you are willing to become comfortable with yourself”. Failure to achieve this comfort is why some clergy became “angry, short [with people], bitter”, he believes.

Accepting himself as he is has contributed positively to his sense of vocation. “I know the margins. I know the edges, the fear of rejection, insult. I know what those experiences are like. If you grow, be honest, be true; that can be positive when dealing with other people on the margins,” he says.

In 1986 in a Vatican document the then cardinal Joseph Ratzinger described homosexuality as “a more or less strong tendency ordered towards an intrinsic moral evil; and thus the inclination itself must be seen as an objective disorder”.

Retired Roman Catholic Priest Weds Gay N.J. Couples; He’ll Marry Partner Too

The Rev. Tom Pivinski helped Asbury Park greet marriage equality by performing ceremonies for three same-sex couples this morning, and he and his long-term male partner have taken out a license as well.

The Roman Catholic Church may not accept same-sex marriage, but one of its retired priests was happy to perform ceremonies for gay and lesbian couples in Asbury Park, N.J., as marriage equality became law in the state today. And he intends to marry his same-sex partner as well.

Tom Pivinski, who now works with an Episcopal church in Asbury Park, officiated vows for three couples on the steps of the Paramount Theater in the beach community shortly after midnight, the Asbury Park Press reports. One of the couples he wed, Karen Nicholson-McFadden and Marcye Nicholson-McFadden, were plaintiffs in the lawsuit that led to marriage equality in New Jersey. He also performed a joint ceremony for City Council member Amy Quinn and her partner, Heather Jensen, and for Steven Brunner and Daniel Baum.

“I think it’s wonderful,” Pivinski told the Press. “I am just very grateful that the state has recognized the equality of all people.” Pivinski and his longtime partner, Malcolm Navias, applied for a license Friday with the intention of marrying today, according to another local news outlet, the Asbury Park Sun.

Same-sex marriages became possible in New Jersey after the state Supreme Court Friday refused to delay a lower court judge’s ruling that such marriages should begin today. The court was to hear Gov. Chris Christie’s appeal of the ruling in January, but this morning Christie dropped the appeal.
