Tracing the Bishops’ Culpability in the Child Abuse Scandal

Pope Francis’ commission on the clergy’s sexual violation of children had a timely private screening in Rome last week of “Spotlight,” the Oscar-nominated film about the pedophilia scandal in Boston. The film offers the Vatican, if it will listen, an emphatic lesson in accountability. It dramatizes the decision by The Boston Globe to do more than enumerate the scope of the scandal by reporting on cases involving scores of abusive priests. The scandal was tracked up the church hierarchy to Cardinal Bernard Law, who eventually had to resign his leadership when the news media, not the church, documented his role as a protector of abusive priests.

Hierarchical accountability remains a pressing issue that the Vatican has not fully confronted in the numerous dioceses of the world where the scandal was suppressed. The pope’s 17-member commission presented fresh evidence of this failing when one of its two abuse-victim members, who had gone to the news media to criticize the slow pace of its work, was suddenly suspended on Saturday in a commission vote of no confidence.

To its credit, the commission, stressing it was only a policy body, had previously urged the pope to create a separate tribunal to judge bishops accused of shielding abusive priests. But Peter Saunders, the suspended commission member, and other abuse victims complained that there has been no progress since the tribunal’s creation last June. They were incensed as well over the pope’s appointment last year of a new diocesan leader in Chile, Bishop Juan Barros, a close associate of a Santiago priestthe Vatican found guilty of child abuse in 2011. The pope nevertheless defended the bishop and was seen on a video complaining that protesterswere “lefties” and “dumb.”

Mr. Saunders may have become an impatient and annoying dissident on a commission charged with developing advisory solutions for the problem, but he has a valid point that Pope Francis cannot afford to ignore. Regaining credibility among the church laity requires clear and timely investigation and punishment of prelates who covered up the rape of children with hush money and rotated abusers to new parishes to commit fresh crimes. “There must be consequences” for offensive church leaders, the laity panelappointed by the United States hierarchy warned over a decade ago.

Unfortunately, no effective method of accountability was devised by the wary American hierarchy, leaving the issue up to Rome. Considering his reputation as a determined reformer, Pope Francis should prod the bishops’ tribunal into action and not let the gaping need for honest and full accountability disappear into the arcane workings of the Vatican.

Irish priest punished by Florida bishop for informing on pedophile colleague

Tyrone priest, Fr John A Gallagher is being punished by unresponsive bishops and Vatican for doing the “right thing,” and having Indian pedophile, Fr Jose Palimatton, investigated by police.

A priest, originally from County Tyrone and now based in the United States, claims he has been “frozen out” of the Catholic Church after calling the police to investigate a fellow clergyman who had shown child-porn images to 14-year-old parishioner.

Fr John A Gallagher (48), from Strabane, Co Tyrone, is now living in a holiday home belonging to one of his friends and parishioners. He says the locks on his parochial house were changed and he was placed on medical leave by his bishop in the Diocese of Palm Beach, FL. Gallagher says he was told by the Catholic Church to put a pedophile priest on a plane back to India rather than cooperate with the police.

Gallagher has been living in the United States since 2000. Prior to this he served in the Long Tower parish in Derry. He is well-known in the Catholic community in the US and has made several religious music records and TV appearances. In 2012 he received a personal note from Pope Benedict XVI thanking him for his work, but Gallagher said this was little comfort as he felt “the wrath” of the Church in the past year.

A local police chief in Palm Beach has also voiced his concern over the treatment of Gallagher and wrote to the Church to complain.

The incident took place in January 2015. Gallagher, who has remained silent on the matter until now, has written to bishops and cardinals in Ireland and America as well as the Vatican but has been unable to locate the Indian clergyman in question. He said he has not received a satisfactory response from the Catholic Church.

The Belfast Telegraph reports that Fr Jose Palimattom, who had been at the parish of the Holy Name of Jesus Christ in West Palm Beach for just one month, approached a 14-year-old boy after Mass. The priest showed the boy as many as 40 images of naked boys. According to ABC news, the tag words in the images included “little boys,” and “young boys 10-18 yoa.”

Palimattom (48), a priest of the Franciscan Province of St Thomas the Apostle in India, was serving a two-year residency at Holy Name of Jesus Parish in West Palm Beach from December 2014.

Police say he was in the first stages of grooming the boy.

The night after Palimattom had shown the young boy the photos he sent him a Facebook message which read “Good night. Sweet dreams.”

The young boy told a friend who reported this to the Church choirmaster, who immediately informed Fr Gallagher.

The Irish priest says that on the night he found out he was told by a Florida Church official, “We need to make him go away, put on a plane.”

He had been instructed to put Fr Palimattom on a plane to Bangalore. Gallagher was also told “do not keep written notes,” by the same official.

All of this has been recorded in documents, filed with the Vatican, by a specialist Canon Lawyer on behalf of Gallagher. These were sent to Cardinal Gerhard Muller, Prefect of the powerful Congregation for the Doctrine of the Faith, in Rome.

Rather than following the Church’s instruction to “make him go away,” Gallagher interviewed Fr Palimattom along with one of his parishioners, a retired police officer. The parishioner took notes at the meeting.

Palimattom admitted to showing nude pictures of boys to the teen. He also admitted that he had sexually assaulted boys in India before arriving in the US. A few hours later he repeated this confession to detectives from the specialist unit of the West Palm Beach Police.

Gallagher contacted the police, following the rules the Catholic Church had set down after hundreds of cases of sexual abuse carried out by the clergy on children.

At the time the Palm Beach diocese released a statement saying that despite prior investigation they had no knowledge of Palimattom’s previous assaults in India.

They said, “As part of its due diligence, the diocese completed a background screening which also included a screening in India, and received a Certificate of Aptitude from the Minister Provincial in India. During this background process, no prior misconduct was revealed.”

Palimattom admitted, ABC news reported, that the prior assaults were not on record as they had not been reported to police. It was also claimed by the media that Palimattom was under orders from the Church to avoid being in the company of minors without other adults in attendance.

Having reported Palimattom’s actions to the police, and despite the fact that he was following the Catholic Church’s own rules, it was made clear to Gallagher that his actions were not approved of.

He said, “It was made clear to me that what I had done (co-operating with the police) wasn’t what I should have done.

“It was a very distressing time for me and the parish. But we had a special Mass and I told the congregation what had happened. I told them it was now in the hands of the rightful authorities, the police.

“Palimattom was on the local TV news as his arrest became public. I did the right thing.”

He was arrested and his bail set at $10,000. The Catholic Church dealt with the victim’s family through lawyers and an out-of-court settlement was made. Palimattom has been sent back to India to an undisclosed location.

In late April 2015 Gallagher was called to meet with the Bishop of Palm Beach, Gerald Barbarito. Three other Church officials were in attendance. Gallagher was in line to be promoted and was surprised to receive a phone call the day after their meeting telling him he was being demoted.

The Irish priest said, “No reason was given. I asked if I could meet with him again and this was refused. He said if I didn’t wish to be demoted and moved to another parish, I should leave the priesthood.”

Four weeks later Gallagher was rushed to hospital with a suspected heart attack. He had become unwell while hearing Confession.

Gallagher said Bishop Barbarito visited him in the hospital but did not anoint him or bring him Communion.

Six days later Gallagher asked Dominican nun, Sister Ann Monahan, to retrieve files on the Palimattom scandal from his office at the Holy Name of Jesus Christ church. She retrieved the files but later when she returned a church official stopped her and took the keys to the building from her. The 84-year-old nun has now been officially retired.

When Gallagher got out of the hospital he found the locks on the parochial house had been changed and a new priest appointed to his parish. Under the bishop’s orders Gallagher was due to leave one month later, in July.

Gallagher said, “I was in shock. I had just suffered a suspected heart attack and wanted to return to my home to recover. Instead, I was homeless.”

In a letter the Bishop suggested that Gallagher needed “treatment” for his mental health. An all-expenses paid trip was offered to him, to a clinic in Pennsylvania. Gallagher refused and has been on paid leave since.

When the police, who were investigating the Palimattom case, learned of Gallagher’s absence they wrote to Church leaders, including Boston’s Cardinal Sean O’Malley, the head of the Pontifical Commission for Child Protection, a group established by Pope Francis in 2014.

Chief Deputy in the Palm Beach County Sheriff’s office Michael Gauger, who has been a cop for 44 years, said this was not the first time that the Church has impeded investigations.

He wrote, “Due to Fr Gallagher’s co-operation the case was swiftly resolved and the opportunity for additional crimes was diminished.

“Educated in the pattern of behavior by those engaged in this inappropriate behavior, the crime could have escalated to something physical which would have been devastating to the victim as well as the Catholic Church.”

Chief Deputy Gauger urged Cardinal O’Malley to ensure the Irish priest received “accolades for his compliance with criminal investigators.”

Another detective working on the case had written a memo to Gauger on May 5, 2015, before Gallagher’s heart attack. Detective Debi Phillips also said she had been hindered by the Church in the past and expected to face the same opposition in Gallagher’s case. However, she was wrong.

She wrote, “Reverend Gallagher and his staff provided timely evidence that was needed to arrest and ultimately convict Jose Palimattom for the felony charge of Showing Obscene Material to a Child.

“If it wasn’t for the co-operation … other children would have also been victimized.”

Gallagher communicates with his Bishop, Gerald Barbarito, only through his canon lawyer.

Gallagher did receive a response from Dublin’s Archbishop, Diarmuid Martin, who wrote back to him and left a voice message. Gallagher now believes that the Church in Ireland can help “break the wall of silence over here (in Florida).”

He continued, “Because of the structure of the Church, each diocese is run separately from the other, so there is no broad church.

“This is now 2016 and this is what happens to whistleblowers in the Catholic Church.

“Pope Francis speaks of ridding our church of the crimes of sexual abuse and being open and honest about doing it. I haven’t seen that in Pope Francis’s Church yet.”

When contacted, none of the parties – from Gallagher’s Palm Beach Diocese, the Pontifical Commission for the Protection of Minors in Rome, or Palimattom’s order in India, the Franciscans Province of St Thomas The Apostle – was available for comment, at the time of this report’s publication.

Italy MPs want couples who use surrogate mums jailed

Italy’s upcoming parliamentary battle over gay civil unions has opened with a group of senators proposing prison terms for couples who use overseas surrogate mothers to have a child.

In a move branded “indecent” by Italy’s biggest gay rights group, Catholic senators from Prime Minister Matteo Renzi’s Democratic Party have tabled an amendment to draft legislation legalizing same sex unions which would require gay couples to prove they had not used a surrogate.

If they cannot, the partner who is not the biological father would not be allowed to adopt the child and a judge would be entitled to have the child placed in care and put up for adoption.

The amendment also envisages prison terms of up to two years and fines of up to €1 million for using a surrogate overseas, regardless of whether the practice is legal in the country concerned. Similar penalties are already in place for anyone entering a surrogacy arrangement in Italy.

“This is indecent. A law intended to recognize rights cannot be transformed into a criminalizing one that talks about prison,” said Gabriele Piazzoni, the national secretary of rights group Arcigay.

The civil unions bill is to be debated by the Senate from January 28th and numerous other amendments are expected to be tabled before a deadline on Friday as conservative lawmakers backed by the Catholic Church mount a rearguard action against it.

The bill is expected to finally pass after examination by both the Senate and the Chamber of Deputies but supporters fear key articles could be watered down or removed.

Opponents, meanwhile, have threatened a constitutional challenge and a campaign for a ratifying referendum if parliament approves gay unions that they think resemble marriage too closely.

Italy is the last major Western European country not to have enacted legislation enabling gay couples to have their relationships legally recognized.

Opinion polls suggest a majority of voters support same-sex couples’ rights to enter civil unions but that the electorate is more evenly split on issues related to adoption, surrogacy and medically assisted procreation.

Interior Minister Angelino Alfano sparked outrage earlier this month when he said the use of paid surrogate mothers should be treated like a sex crime.

What Pope Benedict Knew About Abuse in the Catholic Church

The election of Pope Francis, in 2013, had the effect, among other things, of displacing the painful story of priestly sexual abuse that had dominated public awareness of the Church during much of the eight-year papacy of his predecessor. The sense that the Church, both during the last years of Benedict and under Francis, had begun to deal more forcefully with the issue created a desire in many, inside and outside the Church, to move on. But recent events suggest that we take another careful look at this chapter of Church history before turning the page.

During the past week, a German lawyer charged with investigating the abuse of minors in a famous Catholic boys’ choir in Bavaria revealed that two hundred and thirty-one children had been victimized over a period of decades. The attorney, Ulrich Weber, who was commissioned by the Diocese of Regensburg to conduct the inquiry, said that there were fifty credible cases of sexual abuse, along with a larger number of cases of other forms of physical abuse, from beatings to food deprivation.

The news received widespread attention not only because of its disturbing content but because the director of the Regensburg boys’ choir from 1964 to 1994 was Georg Ratzinger, the older brother of Joseph Ratzinger, who became Benedict XVI. Joseph Ratzinger was the Archbishop of Munich from 1977 until 1981, when he went to head up the powerful Congregation for the Doctrine of the Faith, which establishes theological orthodoxy and was also one of the branches of the Church that dealt with priestly sexual abuse.

The developments in Germany raised the question of what the two Ratzinger brothers knew about the abuse in the Regensburg choir. Most of the sexual abuse took place, apparently, at a boarding school for elementary-grade students connected to the choir. The chief culprit, according to Weber, was Johann Meier, the boarding school’s director from 1953 until 1992. The composer Franz Wittenbrink, a graduate of the school, told Der Spiegel magazine, in 2010, when the abuse scandal became public, that there was “a system of sadistic punishments connected to sexual pleasure.”

At that time, Georg Ratzinger, who was on the three-person supervisory board of the elementary school, acknowledged that some choirboys had complained about the punishments they received at the school. “But I did not have the feeling at the time that I should do something about it,” he told the Passauer Neue Presse, in 2010. “Had I known with what exaggerated fierceness he was acting, I would have said something.”

In fact, accusations of abuse surfaced and were investigated in 1987, but no one saw fit to remove Meier from his post until the year of his death. When asked at his press conference last week whether Georg Ratzinger had been aware of the abuse, Weber replied, “Based on my research, I must assume so.” He estimated that a third of the students in the choir had suffered some form of abuse. Georg Ratzinger has said that he routinely slapped choirboys when their performance was not up to snuff, standard treatment until Germany banned corporal punishment, in the early eighties. So far, the Regensburg diocese has offered compensation of twenty-five hundred euros for each victim.

In the early nineties, a monk who worked at the Vatican told me, “You wouldn’t believe the amounts of money the church is spending to settle these priestly sexual-abuse cases.” He was not exaggerating. By 1992, Catholic dioceses in the U.S. had paid out four hundred million dollars to settle hundreds of molestation cases. These financial settlements were reached largely to keep the victims quiet: in almost all cases, the documents were sealed and the victims signed a non-disclosure agreement. Given the enormous amounts of money involved, the men running the Vatican were well aware of the problem.

The basic outlines of the sex-abuse scandal were already evident that year when Jason Berry, an American journalist, published his first book, “Lead Us Not Into Temptation.” (While the “Spotlight” team at the Boston Globe is rightly getting its moment of glory, praise is also due to Berry, whose pioneering work on the subject, a decade earlier, was done with far less institutional support.) As Berry reported, Ray Mouton, a lawyer whom the Church hired in 1985 to defend a pedophile priest in Louisiana, warned that, if the Church did not adopt a policy for helping victims and removing pedophiles from the ministry, it could face a billion dollars in losses from financial settlements and damage awards in the next decade. It turned out that Mouton had actually underestimated the financial cost of the crisis. By 2006, the Church had spent $2.6 billion settling sexual-abuse cases, as Berry wrote in the 2010 edition of “Vows of Silence,” his second book on the pedophile crisis, which he co-authored with fellow-journalist Gerald Renner.

Most cases of abuse were handled (or not handled) by local bishops and archbishops, but some were adjudicated by Cardinal Ratzinger’s Congregation for the Doctrine of the Faith. The most prominent of these cases was that of Father Marcial Maciel, a favorite of Pope John Paul II and the founder of the Legionaries of Christ, a powerful Mexican religious order that, at its pinnacle, included eight hundred priests, fifteen universities, and a hundred and fifty prep schools, as well as a lay movement with a reported seventy thousand followers.

In the seventies and eighties, former members of the Legionaries reported that, as young boys, they had been sexually abused by Maciel. As the Church later acknowledged, the complainants were highly credible and had no ulterior motives: they were not seeking monetary compensation or notoriety. They followed Church procedures by filing formal charges through ecclesiastical courts in Rome, but nothing was done. In fact, Pope John Paul II called on Maciel to accompany him on papal visits to Mexico in 1979, 1990, and 1993.

When one of the former Legionaries expressed his frustration, in the lawsuit, about the Church’s inaction, Berry and Renner reported in their book, the Legionaries’ own canon lawyer, Martha Wegan, who made no secret that her first loyalty was to the Church, replied, “It is better for eight innocent men to suffer than for millions to lose their faith.”

Cardinal Ratzinger reopened the case against Father Maciel in 2004, and, when he became Pope, in 2006, he acknowledged the validity of the claims, forbidding Maciel to continue his ministry and limiting him to a “life of prayer and penitence.” The Vatican found Maciel guilty of “very serious and objectively immoral acts . . . confirmed by incontrovertible testimonies” that represent “true crimes and manifest a life without scruples or authentic religious sentiment.

Though the sexual-abuse crisis reached its peak in the public sphere during Benedict XVI’s papacy, the single figure most responsible for ignoring this extraordinary accumulation of depravity is the sainted John Paul II. In the context of his predecessor’s deplorable neglect, Pope Benedict gets slightly higher marks than most. In 2001, he acted to give his office, the Congregation for the Doctrine of the Faith, jurisdiction over all sexual-abuse cases, and soon he began to push the Maciel investigation, despite considerable Vatican opposition. After ascending the throne of St. Peter, he became the first Pope to kick predator priests out of the Church: in 2011 and 2012, the last two full years of his papacy, the Church defrocked three hundred and eighty-four offending priests.

That said, it was too little, too late. As the second-most-powerful man in John Paul II’s pontificate, Ratzinger had more ability to know and to act than almost anyone. The actions he finally did take were largely dictated by a series of embarrassing scandals: his move to take control of pedophilia cases in 2001 closely followed scandals in the U.S., Ireland, and Australia, and staggering financial settlements for American plaintiffs. The decision to reopen the case against Maciel would almost certainly not have happened without the courageous reporting of Berry and Renner. And the zero-tolerance policy that led to the systematic defrocking of abusive priests happened only after the annus horribilis of 2010, in which a new sexual-abuse scandal seemed to explode every week and loyal parishioners left the Church in droves.

Ratzinger understood better than most, if late, that priestly abuse was the negation of everything the Church was supposed to stand for. But, for much of his career, his focus and priorities were elsewhere. During most of his tenure, the Congregation for the Doctrine of the Faith was too busy disciplining anyone who dared step out of line with Church teachings on personal sexuality and family planning to bother with the thousands of priests molesting children. In 2009, a nun named Margaret McBride sat on the ethics committee of a San Diego hospital that had to decide the case of a pregnant woman whose doctors believed that she (and her fetus) would die if they did not terminate her pregnancy. The committee voted to allow an abortion, and the woman’s life was saved. Almost immediately, McBride’s bishop informed her of her excommunication. It took multiple decades and thousands of cases of predatory behavior to begin defrocking priests, but not much more than twenty-four hours to excommunicate a nun trying to save a human life. In 2011, also under Pope Benedict, the Vatican lifted its excommunication of McBride.

A reëxamination of the sexual-abuse scandal may help the Church reconsider the standoff between traditionalists and progressives during Francis’s papacy. The traditionalists, who oppose changes such as offering communion to remarried couples, bemoan the good old days when papal authority was unquestioned, civil authorities treated the Church with extreme deference, and parishioners obeyed without objection. They have forgotten that those good old days were also a time when children were slapped, beaten, and often sexually abused, and priests, bishops, parents, and police looked away.

Pope Orders Audit of Church’s Wealth as Whistleblowers Pursued

Pope Francis, galvanized by a scandal over Vatican finances, has ordered the most powerful bodies in the city-state to launch an unprecedented audit of its wealth and crack down on runaway spending.

At the suggestion of his economic chief, Cardinal George Pell, Francis has set up a “Working-Party for the Economic Future” which brings together the Secretariat of State, or prime minister’s office, the Vatican Bank and other agencies.

Francis has told the panel “to address the financial challenges and identify how more resources can be devoted to the many good works of the Church, especially supporting the poor and vulnerable,” Danny Casey, director of Pell’s office at the Secretariat for the Economy, said in an interview.

The pope’s initiatives come as five people stand trial in the Vatican over the leak of confidential documents in two books published last month that described corruption, mismanagement and wasteful spending by church officials. Those on trial deny wrongdoing.

Francis, 78, has pushed for more openness and transparency in Vatican financial and economic agencies but he has faced resistance from the Rome bureaucracy.

Seek Corruption

On the flight back to Rome on Monday after a visit to Africa, Francis told reporters that the so-called Vatileaks II scandal was an indication of the mess that he’s trying to sort out. The trial of two former Vatican employees alongside the books’ authors highlighted Church efforts “to seek out corruption, the things which aren’t right,” he said, according to a transcript provided by the Vatican.

The working group, which held its first meeting last week, will study measures to cut costs and raise revenue as part of a long-term financial plan.

“This will include comparing actual expenditure against budgets at a consolidated level, which is a new initiative,” Casey said.

As officials try to drag the Vatican’s financial management into the 21st century officials will appoint one of the world’s top-four accounting firms to review the Church’s processes, Casey said. The audit will look at financial investments, real estate and cultural assets. The four biggest firms are PricewaterhouseCoopers LLP, Deloitte & Touche LLP, EY LLP and KPMG LLP.

Assets that would never be sold and thus have no market value — including St Peter’s Basilica, the Sistine Chapel and priceless art treasures by Michelangelo — will be included in financial statements though the Vatican is still considering whether and how they should be valued.

While Casey declined to speculate on overall asset values, Pell, his boss, said earlier this year that the Vatican’s total assets were worth more than $3 billion. Separately, the Institute for the Works of Religion, better-known as the Vatican Bank, has 6 billion euros ($6.4 billion) in deposits, and assets under management and custody for clients.

Real Estate

According to the two books which triggered the latest scandal — Avarice, by Emiliano Fittipaldi, and Merchants in the Temple, by Gianluigi Nuzzi — the Vatican’s assets are massively under-valued. For Fittipaldi, its real estate holdings alone are worth an estimated 4 billion euros, four times as much as their book value.

The two volumes relate that Francis himself has denounced costs as being “out of control” and that St Peter’s Pence donations go not to the needy but to Vatican departments. Many cardinals live in apartments of some 500 square meters (5,400 square feet) waited on by aides and surrounded by Renaissance art.

The Australian Pell, prefect at the Secretariat for the Economy, has been drawn into the controversy. Avarice alleges that Pell and three aides, including Casey, accumulated expenses totaling 501,000 euros between July 2014 and January 2015 for costs including business class flights from Rome to London, Munich and Malta.

Resistant to Change

Pell, who denied the allegations when they first surfaced in the Italian magazine L’Espresso in February, declined to respond to a request for comment. Casey said it was “ridiculous” to suggest the spending was for personal expenses.

“The Cardinal is committed to cost-management as is his whole team,” he said. “Unfortunately every leader working on the financial reforms has at some stage been criticized either personally or professionally — this is a classic diversionary tactic and perhaps a sign that good progress is being made.”

While Francis recruiting experts from outside the Church is a step in the right direction, the pontiff may not be around long enough to see through his reforms, according to papal biographer, Austen Ivereigh. Francis has told his entourage that he plans to remain pontiff until 2020, Ivereigh said — an indication he may then resign, like his predecessor Benedict XVI.

The Vatican can be reformed “but it will take a generation because the existing practices and mindset are so well-established,” Ivereigh said. “The Curia is built to resist change. Historically it was designed to be impervious to outside influence.”
