Roman Catholic Church faces human-rights case over dismissal of employee

Ginette Chaumont says she devoted her life to the Roman Catholic Church, forgoing marriage and a family to serve for 22 years as the assistant to a series of Ottawa archbishops before menopause left her depressed, disorganized and inefficient.

Ms. Chaumont, who is now 59, recognized her failings and tried to compensate by working unpaid overtime. But, in November, 2011, she was summoned to a meeting with Monsignor Kevin Beach. “He told me at that time that I was being dismissed,” she told The Globe and Mail on Monday. “He said the Archbishop no longer had any confidence in my doing his work.”

Stripped of the demanding job that had been her “compass point,” and unable to find new employment despite sending out hundreds of resumes, she has launched a human-rights case against the church which she said still “means everything to me.”

The problems she experienced in 2011 were not Ms. Chaumont’s first bout with mental issues. She was diagnosed with clinical depression in 2005, but was treated and the symptoms subsided – until she hit menopause in the winter before her dismissal.

The church that had paid for her master’s degree in canon law, from which she says she received multiple commendations for excellent service, was not getting the best she had to offer. But “I didn’t really feel comfortable asking for accommodations a second time,” she explained.

Church officials did not raise their concerns until she was suddenly cut loose, Ms. Chaumont said. “Basically, my whole life revolved around the church and, once my job was gone, it was like I was left facing nothing.”

For its part, the church says there is no foundation to her claim of discrimination. “The Archdiocese is prepared to defend its position before the Human Rights Tribunal of Ontario,” Sarah Du Broy, a spokeswoman for the Archdiocese, said in an e-mail.

In its response to Ms. Chaumont’s human-rights complaint, the Archdiocese says she was advised during the termination meeting that, when she came back from her summer vacation in 2011, “she had returned to the problematic patterns of behaviour she previous exhibited.” And “given that she did not correct the problematic behaviours which had previously been addressed with her, her employment was being terminated.”

But Ms. Chaumont’s lawyer, Alan Riddell, said courts and tribunals say every employer must try to accommodate employees in cases of illness. Yet “this employer, the Archdiocese, didn’t lift a finger to accommodate the symptoms of the disability and the menopause,” he said. “The medical literature confirms that there is a very strong link in many women between diminished concentrative powers and efficiency and organization in the workplace and the onset of menopause.”

Mr. Riddell also pointed to the recent case of an Ottawa priest named Rev. Joe LeClair, a diagnosed pathological gambler who was convicted of stealing $130,000 from his church over the course of five years. Ottawa Archbishop Terrence Prendergast has said that, when Father LeClair has served his time, he will assist the priest in returning to his ministry.

“Unlike Father Joe, she never stole or lied to anyone,” Mr. Riddell said of Ms. Chaumont.

The message the Archbishop is sending to the community, said the lawyer, “is that, if you are a male priest, you will be forgiven and reinstated to the payroll, no matter what laws you break and how much money you steal. But, if you are a female assistant who leads a good Catholic life, as Ms. Chaumont did for all of her 60 years, you will be dumped onto the street just as fast as Hell can scorch a feather, just as soon as you run into serious health problems.”

Case dropped in church prosecution of scholar; bishop vows “cessation of trials”

At a joint press conference today, United Methodist Bishop Martin McLee and Rev. Dr. Thomas W. Ogletree announced that the church was dropping the case against Dr. Ogletree for officiating at his son’s wedding. In a huge victory for the Methodist movement that is organizing ministry to all couples on an equal basis in open defiance of church law, the bishop dropped the case without any conditions. Furthermore, Bishop McLee said in his statement “I call for and commit to cessation of trials,” the first time ever a sitting United Methodist bishop has categorically declared he will not prosecute pastors for ministering to LGBTQ people.

Rev-Dr-Ogletree“I am grateful that Bishop McLee has withdrawn this case and the church is no longer prosecuting me for an act of pastoral faithfulness and fatherly love,” said Dr. Ogletree. “But I am even more grateful that he is vowing not to prosecute others who have been likewise faithful in ministry to LGBTQ people. May our bishop’s commitment to cease such prosecutions be the beginning of the end of the United Methodist Church’s misguided era of discriminating against LGBTQ people.” Ogletree, a past dean of both Yale Divinity School and Drew Theological Seminary, a scholarly expert in Christian ethics, and an author of a section of the UMC’s Book of Discipline, began his service to the church in 1952, a time when Methodist rules barred women from serving as clergy and segregated African Americans into a separate central jurisdiction.

The decision to drop the case was satisfactory to Dr. Ogletree (who under UMC law had the right to insist on a trial to adjudicate his case) because it did not require him to say he would not conduct same-sex weddings in the future, nor did it in any way frame what he did as “wrong.” Rather, the bishop’s statement acknowledges that church trials “continue the harm brought upon our gay and lesbian brothers and sisters” and invites Dr. Ogletree to “a public forum on the true nature of the covenant that binds us together,” where he can tell his story about why he performed this wedding and how he understands that act to be consistent with the Wesleyan tradition and Christian ethical principles.

“This resolution completely vindicates Tom,” said Dr. Dorothee Benz, the spokesperson for Ogletree and chair of Methodists in New Directions, which provided Ogletree’s legal defense. “While it is good that Tom will not have to stand trial for saying ‘yes’ when his son asked ‘Dad, will you do my wedding?’ it is important to remember that trials are not the problem in the United Methodist Church, they are merely the symptom. The problem is the wholesale condemnation of gays and lesbians as ‘incompatible with Christian teaching’ and the systematic discrimination against us and those who would dare to minister to us.

“The declaration that he will no longer prosecute pastors like Tom who refuse to deny ministry to LGBTQ people is a bold act of leadership for our bishop, whose longstanding support herewith takes a new step that mirrors our own refusal to follow discriminatory laws,” Benz added.

With the agreement announced today, Bishop McLee joins a small but growing number of U.S. bishops who are openly breaking with their colleagues’ insistence on enforcing the UMC’s anti-gay discriminatory rules. In October 2013 retired Bishop Talbert became the first bishop to preside at a same-sex wedding. After the Council of Bishops voted to direct two of its members to file a formal complaint against Bishop Talbert, four bishops took the unprecedented step of issuing statements publicizing their dissent in that vote. In December, after the Eastern Pennsylvania Board of Ordained Ministry moved to strip Frank Schaefer of his ministerial credentials, Bishop Minerva Carcano publicly offered him a job as a pastor in the California-Pacific Annual Conference.

Bishop McLee’s actions today go farther than any other active bishop has gone thus far in that they publicly commit him to a policy of not punishing pastors for their ministry to LGBTQ people.

Tom Ogletree’s case began in October 2012, when a complaint was filed against him after his son’s wedding was listed in the New York Times wedding announcements. A formal just resolution process followed, in which Ogletree made clear that a promise to never do another same-sex wedding was not a condition he could accept, and in March 2013, Bishop McLee referred the case to counsel for the church. Formal charges against Tom were filed in January 2014, and Tom was notified of the charges and the trial date (March 10) on January 16. He has been represented by Rev. Scott Campbell and Rev. Paul Fleck, who are members of MIND’s legal team.

While the resolution is a victory for the movement to end UMC discrimination and a vindication for Ogletree, it cannot undo the strain he and his family endured during the 16 months that the case was pending.

Church brings 1st Amendment into Eastside Catholic lawsuit

A gay vice principal who was forced out of his job at Eastside Catholic School filed a discrimination and wrongful termination lawsuit against the school and church on Friday. Lawyers for the church and school planned to respond immediately with a motion arguing King County Superior Court does not have jurisdiction to hear the case without violating the First Amendment.

The case has stirred debate at the school and in front of the Seattle Archdiocese and has led to several online petitions arguing for reinstatement of the popular teacher, coach and administrator and calling for a change in church doctrine on gay marriage.

The school and the church decided Mark Zmuda couldn’t continue in his job after they learned he had married his same-sex partner. They cited an employment agreement Zmuda had signed that said his public behaviors would at all times be consistent with the values and teachings of the Catholic Church. An attorney for the school acknowledged that school leadership floated the idea that Zmuda could possibly get a divorce to keep his job.

“I was asked by the school to break my wedding vows to keep my job,” Zmuda said at a news conference Friday. “I was told I could either divorce or be fired. How could anyone ask anyone else to make that choice?”


In the response they plan to file to the lawsuit, lawyers for the church argue the case “would impermissibly entangle the Court in Catholic doctrine,” and would lead the court to examine the church’s definition of marriage.
The lawsuit Zmuda filed in King County Superior Court accuses the school and the church of discrimination, wrongful termination and violation of the state consumer protection laws. Zmuda’s lawyers argue he was not a religious employee of the school.

“I am a lifelong Catholic,” Zmuda said. “I am a gay man. I did not choose to be gay. I do not see any inconsistency in the teachings of Jesus and being gay.”

Zmuda’s lawsuit notes that the school previously posted a statement on its website that it does not discriminate based on marital status or sexual orientation but that statement was removed after his dismissal. A similar statement was included in the employee handbook.

“I relied on those statements,” Zmuda said.

Zmuda has said the school’s administrators were aware that he is gay and that he was in a relationship. Administrators asked him not to bring his partner to school functions, according to the lawsuit.

The school sent a letter home to parents on Thursday, saying the school’s board of directors would handle legal issues and the administrators would continue to run the school.

UN committee blasts Vatican on sex abuse, abortion

The Vatican “systematically” adopted policies that allowed priests to rape and molest tens of thousands of children over decades, a U.N. human rights committee said Wednesday, urging it to open its files on pedophiles and bishops who concealed their crimes.

st petersIn a devastating report hailed by victims, the U.N. committee severely criticized the Holy See for its attitudes toward homosexuality, contraception and abortion and said it should change its own canon law to ensure children’s rights and their access to health care are guaranteed. The Vatican promptly objected.

The report puts renewed pressure on Pope Francis to move decisively on the abuse front and make good on pledges to create a Vatican commission to study sex abuse and recommend best practices to fight it. The commission was announced at the spur of the moment in December, but few details have been released since then.

The committee issued its recommendations after subjecting the Holy See to a daylong interrogation last month on its implementation of the U.N. Convention on the Rights of the Child, the key U.N. treaty on child protection, which the Holy See ratified in 1990.

Critically, the committee rejected the Vatican’s longstanding argument that it doesn’t control bishops or their abusive priests, saying the Holy See was responsible for implementing the treaty not just in the Vatican City State but around the world “as the supreme power of the Catholic Church through individuals and institutions placed under its authority.”

In its report, the committee blasted the “code of silence” that has long been used to keep victims quiet, saying the Holy See had “systematically placed preservation of the reputation of the church and the alleged offender over the protection of child victims.” It called on the Holy See to provide compensation to victims and hold accountable not just the abusers but also those who covered up their crimes.

“The committee is gravely concerned that the Holy See has not acknowledged the extent of the crimes committed, has not taken the necessary measures to address cases of child sexual abuse and to protect children, and has adopted policies and practices which have led to the continuation of the abuse by, and the impunity of, the perpetrators,” the report said.

It called for Francis’ nascent abuse commission to conduct an independent investigation of all cases of priestly abuse and the way the Catholic hierarchy has responded over time, and urged the Holy See to establish clear rules for the mandatory reporting of abuse to police and to support laws that allow victims to report crimes even after the statute of limitations has expired.

No Catholic bishop has ever been sanctioned by the Vatican for sheltering an abusive priest, and only in 2010 did the Holy See direct bishops to report abusers to police where law enforcement requires it. Vatican officials have acknowledged that bishop accountability remains a major problem and have suggested that under Francis, things might begin to change.

The committee’s recommendations are non-binding and there is no enforcement mechanism. Rather, the U.N. asked the Vatican to implement the recommendations and report back by 2017. The Vatican was 14 years late submitting its most recent report.

While most attention has focused on child sex abuse, the committee’s recommendations extended far beyond, into issues about discrimination against children and their rights to adequate health care, issues that touch on core church teaching about life and sexual morals.

The committee, for example, urged the Vatican to amend its canon law to identify circumstances where access to abortion can be permitted for children, such as to save the life of a young mother. It urged the Holy See to ensure that sex education, including access to information about contraception and preventing HIV, is mandatory in Catholic schools. It called for the Holy See to use its moral authority to condemn discrimination against homosexual children or children raised by same-sex couples.

The Vatican said it would study the report and in a statement reiterated its commitment to defending and protecting children’s rights that are enshrined in the treaty. But it took issue with the committee’s recommendations to change core church teaching on life.

“The Holy See does, however, regret to see in some points of the concluding observations an attempt to interfere with Catholic Church teaching on the dignity of human person and in the exercise of religious freedom,” the Vatican said.

Church teaching holds that life begins at conception; the Vatican therefore opposes abortion and artificial contraception. The Vatican has a history of diplomatic confrontation with the United Nations over such issues.

Austen Ivereigh, coordinator of Catholic Voices, a church advocacy group, said the report was a “shocking display of ignorance and high-handedness.”

He said it failed to acknowledge the progress that has been made in recent years and that the Catholic Church in many places is now considered a leader in safeguarding children. And he noted that the committee seemed unable to grasp the distinction between the responsibilities and jurisdiction of the Holy See, and local churches on the ground.

“It takes no account of the particularities of the Holy See, treating it as if it were the HQ of a multinational corporation,” he said in an email.

But victims groups hailed the report as a wake-up call to secular law enforcement officials to investigate the abuse and cover-up and prosecute church officials who are still protecting predator priests.

“This report gives hope to the hundreds of thousands of deeply wounded and still suffering clergy sex abuse victims across the world,” said Barbara Blaine, president of the main U.S. victim’s group SNAP. “Now it’s up to secular officials to follow the U.N.’s lead and step in to safeguard the vulnerable because Catholic officials are either incapable or unwilling to do so.”

Melbourne Priest Greg Reynolds Defrocked And Excommunicated By The Vatican

Melbourne priest Greg Reynolds has not only been defrocked, but also excommunicated by the Catholic Church over his support for women priests and homosexuals. The order came directly from Vatican under the authority of Pope Francis, who just recently said that the Church focuses too much on gays and abortion.

Fr-Greg-ReynoldsMr Reynolds resigned as a parish priest in 2011, and has founded Inclusive Catholics in 2012. He said that although he was expecting to be laicised or defrocked for his views on ordination of women and homosexuality, he didn’t know he was to be excommunicated as well.

Excommunication is a form of medicinal penalty for members of the Catholic Church. Those who are excommunicated are barred from receiving the Eucharist and other Sacraments of the church.

“In times past excommunication was a huge thing, but today the hierarchy have lost such truth and respect,” he was quoted by The Age as saying.

“I’ve come to this position because I’ve followed my conscience on women’s ordination and gay marriage.

The order, written in Latin, came from Vatican through the authority of Pope Francis, and gave no reason for the former priest’s excommunication.

The letter was dated May 31, months before the Pope told his subjects to go easy on how they deal with gays, abortion, and contraception. Mr Reynolds continued to The Age that he wants the same thing as the Pope, adding that he believes that the Church is in need of reform and renewal.

“My motivation is trying to encourage reform and clear need for renewal in the church,” he said. “I still love the church and am committed to it, I’m just trying to bring about in my own little way to help highlight some of the failing and limitations.”

Melbourne Archbishop Denis Hart, who made headlines in May after appearing at a Victorian parliamentary inquiry into a child sex abuse case of another priest, apparently was not the one who requested the order, “but someone else unknown has gone over his head and contacted the Congregation of the Doctrine of the Faith,” Mr Reynolds said.

Archbishop Hart explained that Mr Reynolds was excommunicated because he continued to celebrate the Eucharist publicly after his priestly faculties were withdrawn. He was also preaching contrary to the teachings of the church.

As per its official Web site, Inclusive Catholics is an evolving movement/community in Melbourne that has recognises the hierarchical nature of the Catholic Church, but opposes its views on homosexuality and the ordination of women.

Mr Reynolds said that his being excommunicated would not make a different to his ministry.

He was offered $5000 as a payout for his 32 years of service in the church when he resigned, though he claimed he should have received $48,000 as the usual payout figure is about $1500 per year.
